Terms of Service

These Terms of Service (“Terms”) govern your use of the PreSpend mobile application (“App”) operated by PreSpend (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms. If you disagree with any part, please do not use the App.

1. The Application

PreSpend is a planning-first personal budgeting app designed to help you commit your income to expense categories before the month begins. The App is currently available on Android and is intended for personal, non-commercial use.

PreSpend is not designed to comply with industry-specific regulations such as HIPAA or FISMA. If your use would be subject to such regulations, you may not use the App. You may not use the App in a way that would violate applicable financial regulations including the Gramm-Leach-Bliley Act (GLBA).

2. Scope of License

2.1 We grant you a personal, non-transferable, non-exclusive, non-sublicensable licence to install and use the App on devices you own or control, subject to these Terms.

2.2 This licence covers any updates we provide that replace or supplement the original App, unless a separate licence is provided for that update.

2.3 You may not share, sell, rent, lend, lease, or otherwise redistribute the App to third parties without our prior written consent.

2.4 You may not reverse engineer, decompile, disassemble, translate, modify, or attempt to derive the source code of the App or any part of it.

2.5 You may not remove or obscure any copyright, trademark, or other intellectual property notices in the App.

3. Technical Requirements

3.1 We aim to keep the App compatible with current Android versions and hardware. You are not entitled to any specific update.

3.2 You are responsible for ensuring your device meets the technical requirements needed to run the App.

4. Maintenance and Support

4.1 PreSpend is solely responsible for providing maintenance and support for the App. You can reach us at support@prespend.app.

4.2 Google, as the distributor via Google Play, has no obligation to provide any maintenance or support for the App.

5. User-Generated Contributions

The App allows you to create and store budget data including expense plans, categories, and income entries (“Contributions”). You represent and warrant that your Contributions:

• Do not infringe the intellectual property rights of any third party
• Do not violate any applicable law or regulation
• Do not violate the privacy or publicity rights of any third party

6. Contribution Licence

6.1 You retain full ownership of your Contributions and all associated intellectual property rights. By using the App, you grant us permission to access, store, and process your data solely to provide the service (for example, to enable cloud sync) in accordance with our Privacy Policy.

6.2 If you submit suggestions or feedback about the App, you agree that we may use and share that feedback for any purpose without compensation to you.

7. Limitation of Liability

7.1 TO THE EXTENT PERMITTED BY LAW, PRESPEND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

7.2 PreSpend provides budgeting tools to help you plan — it does not provide financial advice. Any financial decisions you make based on the App are your sole responsibility.

7.3 In no event shall our total liability to you exceed fifty dollars (USD $50.00).

8. Warranty Disclaimer

8.1 We warrant that the App does not contain known malware at the time of release and that it functions as described in the documentation.

8.2 No warranty applies if the App has been modified, misused, or used with incompatible hardware or software.

8.3 THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Product Claims

PreSpend — not Google — is responsible for addressing claims relating to the App, including product liability claims, claims that the App fails to meet a legal requirement, and claims under consumer protection or privacy legislation.

10. Legal Compliance

By using the App, you represent that:

• You are not located in a country subject to a relevant government embargo or designated as supporting terrorism
• You are not listed on any government list of prohibited or restricted parties

11. Termination

This licence remains in effect until terminated by PreSpend or by you. Your rights under this licence terminate automatically, without notice, if you fail to comply with any of these Terms. Upon termination, you must stop using the App and delete any copies from your devices.

12. Refunds

Purchases and subscriptions made through Google Play are subject to Google’s refund policy. Refund requests should be submitted directly through Google Play. PreSpend is not able to process refunds independently of the app store.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
